Representative Cases and Decisions
- Represented a landowner in the Ninth Circuit and overturned a District Court's entry of summary judgment finding liability under CERCLA. Voggenthaler v. Maryland Square, LLC, 724 F.3d 1050 (9th Cir. 2013).
- Successfully defended appellate challenge to a Massachusetts Superior Court verdict award under Massachusetts Tort Claims Act to an individual injured as a result of the negligence of employees of Bridgewater State Hospital. Devlin v. Commonwealth, 83 Mass. App. Ct. 530 (2013).
- Defended national nonprofit membership organization against claims of copyright and trademark infringement. Lyons v. Gilette, 882 F. Supp. 2d 217 (D. Mass. 2012); Lyons v. Am. Coll. of Veterinary Sports Med. & Rehab., 997 F. Supp. 2d 92 (D. Mass. 2014).
- Successfully represented landowner in defeating neighbor's claimed right to use land. O'Connell v. White, 87 Mass. App. Ct. 1113 (Rule 1:28 Decision) (2015).
- Defended national medical research organization against claims of defamation. Saad v. Am. Diabetes Ass'n, 2015 U.S. Dist. LEXIS 108977 (D. Mass. 2015)
- Successfully defended individual against claims of illegally downloading copyrighted material. Third World Media, LLC v. Does 1-21, (D. Mass. 2013).
- Successfully defended taxi cab dispatch company against independent contractor misclassification claims. Kubinec v. Top Cab Dispatch, Inc., 2014 Mass. Super. LEXIS 93 (Bus. Lit. Sess. 2014).
- Regularly defend debt collection companies from allegations of unfair debt collection practices. In one such decided matter, successfully moved to compel arbitration. E.g., Schwartz v. CACH, LLC, No. 13-12644-FDS (D. Mass.).
- Successfully defended commercial debt collector from claims of unfair and deceptive acts and nuisance. Gerritystone v. Boston Kitchen Design, Inc., No. MICV2014-06441 (Mass. Super. Ct. 2015)
- Successfully defended the City of Boston against an unfair labor claim challenging its decision to conduct a promotional exam to appoint superior police officers. In re City of Boston and Boston Police Superior Officers Federation, Boston Police Detectives Benevolent Society, and Boston Police Patrolmen's Association 41 M.L.C. 119 (Mass. Dep't Labor Relations 2014).
